The Practice Rules of the Appellate Division, complemented by Second Department Rules of Practice, are effective as of September 17, 2018. One of the new procedures required under these rules is the submission of a digital copy of all records, appendices and briefs filed in hard copy with the court (see, 22 NYCRR §§ 1250.9[a][1], [a][2], [a][4], [c][1], [c][2]. [d]]). Pro se or unrepresented parties are exempt from this requirement (see, 22 NYCRR § 1250.9[e]). While the Second Department Rules of Practice provide for the submission of those digital copies via e-mail (see, 22 NYCRR § 670.9[a]), in an effort to better serve its constituents the court will instead accept those filings through a digital portal.
Please note that digital copies must comply with the technical requirements set forth Attachment A of the Electronic Filing Rules of the Appellate Division, as well as the Technical Guidelines of the Second Department.
