2025 Primary Election Appeals – Dates and Briefing Schedule

The primary elections for the state and local elections in New York will be held on June 24, 2025. By order dated March 4, 2025, the Appellate Division, First Judicial Department has set Tuesday, May 6, 2025, and if necessary, Wednesday, May 7, 2025, as the date(s) to hear oral arguments on appeals related to the primary elections.

All election appeals shall be perfected by April 28, 2025, and responding briefs shall be served and filed by May 2, 2025. Election appeals are subject to mandatory e-filing in the First Department.

The time available between the trial court proceedings and the Appellate Division’s briefing schedule and election appeal calendar is very limited. Parties who want to have an election matter placed on the Court’s calendar must contact the Clerk’s Office at 212-340-0422 for filing instructions, immediately upon release of the Supreme Court order.
