Appeal from an order of the Supreme Court, Kings County, dated November 10, 2021, and a judgment of the same court dated November 15, 2023. By decision and order on motion of this Court dated December 23, 2024, the parties were directed to serve and file, via NYSCEF, replacement briefs which contain Appellate Division Docket No. 2024-01754, in addition to Appellate Division Docket No. 2021-09464 on the covers. The respondent has not filed the replacement respondent's brief.
Now, on the Court's own motion, it is
ORDERED that the parties to the appeals are directed to show cause before this Court why an order should or should not be made and entered striking the respondent's brief for failure to comply with the decision and order on motion of this Court dated November 6, 2024, by serving and filing an affirmation or affidavit on that issue, via NYSCEF, on or before April 14, 2025; if the respondent be so advised, the respondent may make a motion, via NYSCEF, on or before April 14, 2025, for any relief deemed appropriate; and it is further,
ORDERED that the Clerk of the Court, or his designee, shall serve a copy of this order to show cause upon the parties to the appeal by uploading a copy of this order to show cause to the NYSCEF system.
