DECISION & ORDER ON MOTION

Appeal from a judgment of the County Court, Suffolk County, rendered April 6, 2023. Motion by the appellant to hold the appeal in abeyance pending determination of a motion before the County Court, and, in effect, to extend the time to comply with two prior decisions and orders on motion of this Court dated September 20, 2024, and November 8, 2024.

Upon the papers filed in support of the motion and the papers filed in relation thereto, it is

ORDERED that the branch of the motion which is to hold the appeal in abeyance pending determination of a motion before the County Court is denied; and it is further,

ORDERED that the branch of the motion which is to extend the appellant's time to comply with the decisions and orders on motion of this Court dated September 20, 2024, and November 8, 2024, is granted, and and on or before April 7, 2025, the appellant shall serve and file a replacement brief and appendix which contain copies of the relevant transcripts of the proceedings, via NYSCEF, if applicable, or, if NYSCEF is not mandated, serve the replacement brief and appendix and upload digital copies of the replacement brief and appendix, with proof of service thereof, through the digital portal on this Court's website.
