| DECISION & ORDER ON MOTION |
Appeal, by permission, from a decision and order of the Appellate Term, Second, Eleventh, and Thirteenth Judicial Districts, dated May 20, 2022, which determined an appeal from an order of the Civil Court of the City of New York, Kings County, dated July 31, 2019. Motion by
the appellant, in effect, to stay enforcement of so much of the decision and order as permits the respondent to demolish, reconfigure, or otherwise alter the subject premises, and to re-let or transfer possession of the subject premises or, in the alternative, to vacate a judgment and a warrant of eviction of the Civil Court of the City of New York, Kings County, dated December 20, 2024, and to restore the appellant to possession of the subject premises, pending hearing and determination of the appeal.
Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is
ORDERED that the motion is granted to the extent that enforcement of so much of the decision and order as permits the respondent to demolish, reconfigure, or otherwise alter the subject premises is stayed, pending hearing and determination of the appeal, and the motion is otherwise denied.
