Motion by appellant to, in effect, vacate an order of this court dated April 22, 2024, which dismissed an appeal from a judgment of the Civil Court of the City of New York, entered July 10, 2023. Separate motion for leave to expand the record.
Upon the papers filed in support of the motions and no papers having been filed in opposition thereto, it is
ORDERED, on the court's own motion, that the motions are consolidated for purposes of disposition; and it is further,
ORDERED that the motion to vacate the dismissal is granted, the order dated April 22, 2024 is vacated, and the appeal shall be perfected on or before March 31, 2025; and its further,
ORDERED that in the event the appeal is not perfected by March 31, 2025, the court, on its own motion, may dismiss the appeal, or respondent may move, on three days' notice, to dismiss the appeal, and may serve such application upon appellant in person; and it is further,
ORDERED that the motion to expand the record is denied.
