Appeal and cross-appeal from an order of the Supreme Court, Queens County, dated September 27, 2023. The appeal from the order was deemed dismissed pursuant to 22 NYCRR 1250.10(a). Motion by the respondent-appellant to extend the time to perfect the cross-appeal.
Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is
ORDERED that on the Court's own motion, the cross-appeal is dismissed, without costs and disbursements, on the ground that the respondent-appellant is not aggrieved by the order (see CPLR 5511); and it is further,
ORDERED that the motion is denied as academic.
