An appeal having been taken herein from a Judicial Surrender executed and acknowledged before the Family Court, Oswego County, on June 27, 2024,
Now, upon the Court's own motion,
It is hereby ORDERED that the notice of appeal filed July 17, 2024, shall be treated as valid as to the order of Family Court entered July 16, 2024, and
It is further ORDERED that the appeal is dismissed on the ground that no appeal lies from an order entered upon consent (see Matter of Cherilyn P., 192 AD2d 1084, 1084 [4th Dept 1993], lv denied 82 NY2d 652 [1993]).
