An order having been entered on December 13, 2023, granting respondent-appellant's application to perfect an appeal taken herein as a poor person and assigning Kenneth Tyler, Esq., as counsel to perfect the appeal,
Now, upon reading and filing the statement of Kenneth Tyler, Esq., dated May 7, 2024, and due deliberation having been had thereon,
It is hereby ORDERED that Andrew DiPasquale, Esq., 45 Exchange Boulevard, Suite 400, Rochester, New York 14614, is hereby substituted as counsel to conduct the above-entitled appeal taken from an order of the Family Court, Onondaga County, entered October 20, 2023, in place and stead of Kenneth Tyler, Esq., and
It is further ORDERED that the Onondaga County Family Court Clerk provide Andrew DiPasquale, Esq. with copies of all papers and transcripts of stenographic or audiotaped minutes, if any, of the proceedings upon which the appeal is based, and
It is further ORDERED that the time to perfect the appeal is extended to August 6, 2024, and, in the event of failure to so perfect, the appeal is hereby dismissed without further order.
