Defendant having moved for a writ of error coram nobis seeking leave to file and serve a late notice of appeal from a judgment of the Monroe County Court, rendered February 7, 2020, and to dismiss the appeal taken herein from a judgment of the Monroe County Court, rendered August 16, 2019,
Now, upon reading and filing the papers with respect to the motion, and due deliberation having been had thereon,
It is hereby ORDERED that the motion insofar as it requests permission to file and serve a late notice of appeal is granted, and James A. Hobbes, Esq. is directed to file and serve the notice of appeal in accordance with CPL 460.10 on or before June 20, 2024, and
It is further ORDERED that the motion insofar as it requests dismissal is denied without prejudice to renew.
