An order having been entered on February 23, 2023, granting respondent-appellant's application to perfect an appeal taken herein as a poor person and assigning Philip Rothschild, Esq., and an order of this Court having been entered on May 3, 2024, affirming the order of Family Court, Onondaga County, entered December 2, 2022,
Now, upon reading and filing the statement of Thomas Babilon, Esq., dated May 7, 2024, and due deliberation having been had thereon,
It is hereby ORDERED that Melissa Swartz, Esq., 300 South State Street, First Floor, Syracuse, New York 13202, is substituted as counsel for the purpose of filing and serving an application for leave to appeal to the Court of Appeals from the order of this Court entered May 3, 2024, and
It is further ORDERED that the Onondaga County Family Court Clerk provide Melissa Swartz, Esq. with copies of all papers and transcripts of stenographic or audiotaped minutes, if any, of the proceedings upon which the appeal is based.
