Appeal from an order of the Civil Court of the City of New York, Queens County (Anna
Culley, J.), entered June 14, 2010, deemed from a judgment of the same court entered June 24,
2010 (see CPLR 5501 [c]). The judgment, entered pursuant to the June 14, 2010 order granting
defendant's motion for summary judgment, dismissed the complaint.
ORDERED that the judgment is affirmed, without costs.
For the reasons stated in Rally Chiropractic, P.C. v Nationwide Mut. Ins. Co. (___ Misc 3d ___, 2012 NY Slip Op _____ [Appeal No. 2010-2004 Q C], decided herewith), the judgment of the Civil Court is affirmed.
