Dear : 

 This responds to your inquiry (22-14), as a new full-time judge, asking if you may continue to serve as a part-time seasonal lifeguard with the New York State Office of Parks, Recreation and Historic Preservation and receive compensation.

 

         The Rules Governing Judicial Conduct provide that no full-time judge shall solicit or receive compensation for extra-judicial activities performed for or on behalf of “New York State, its political subdivisions or any office or agency thereof” (22 NYCRR 100.4[H][1][c]).

 

         Accordingly, it is not ethically permissible for you to continue receiving compensation for serving as a lifeguard for the State of New York (see e.g. Opinions 14-177; 03-130).

 

         Enclosed for your convenience are Opinions 14-177; 03-130 which address this issue.
