         This is in response to your inquiry (96-61) in which you ask whether the law firm that employs you as an attorney is permitted to appear before a part-time justice/attorney of a town court which is located in the same county as the court where you preside.


         Section 100.6(B)(3) of the Rules Governing Judicial Conduct states, in part, that a part-time judge who is permitted to practice law “may permit the practice of law in his or her court by the partners or associates of a judge of a court in another town, village or city who is permitted to practice law.” Thus, it appears that the judge/attorney of the town court mentioned in your inquiry may permit the law firm with which you are associated, but not yourself, to practice law in that court.
