This is in response to your inquiry (96-104) concerning the estrangement between yourself and your brother who is a supervisor in the county Probation Department. You indicate that there is pending litigation between you and your brother concerning your mother’s estate; that he sought unsuccessfully to have you arrested for harassment; and that he intends to contact the State Commission on Judicial Conduct. You further inform the Committee that you have informed the County Director of Probation that because of increased hostility demonstrated by your brother you have decided not to handle any of your brother’s probation cases, but will deal with the two other supervisors in the Probation Department.
Under the circumstances presented, including your letter to the Director of Probation, the Committee is of the view that a question of judicial ethics for resolution by the Committee is not presented.
