Opinion 95-87
June 29,1995
Note on terminology: This Opinion uses the term "town council" as a synonym for "town board."
Hon.
Dear Judge:
This is in response to your letter of May 26,1995 (inquiry 95-87), concerning the propriety of the clerk of the court running for the position of town councilman.
The Committee is of the view that based on the facts provided, there is no question of judicial ethics at issue. Rule 100.3(b)(5) of the Rules of the Chief Administrator applies only to a judge's personal appointee, and it does not appear that the clerk is such a personal appointee.
Very truly yours,
Louis J. Benza
For the Committee
