Digest:         A town justice may not accept a position as an employee in the county Probation Department.

Opinion:

         A town justice asks whether there would be a conflict of interest if the justice accepted a position in the county Probation Department as Account Clerk/Typist doing data entry.

         In the Committee's opinion, the justice may not accept the position, as the public could have the perception that the justice might be unduly influenced in the performance of judicial duties by his/her supervisors in the Probation Department or by recommendations made by those supervisors in cases pending before the court.
