Dear Justice


         On June 16, 1994, the Advisory Committee on Judicial Ethics considered your inquiry (93-64), dated May 23, 1994, concerning non-jury pre-trial conferences with the defendant, conducted by the District Attorney.


         The Committee is of the view that a notice of a pre-trial conference may be sent to a defendant, but only under the aegis of the District Attorney. Such notice should not be sent in the name of the court or of the clerk of the court, as the court is not a participant in the conference.
