Digest:         A full-time judge may apply personally for a law school teaching position within the Court's geographical jurisdiction.

Rule:            22 NYCRR 100.6(d)(2)

Opinion:

         A full-time judge asks whether it is permissible to apply in writing for a position as an adjunct professor of law at schools of law within the geographical boundaries of his/her court.

         The answer to this inquiry is found in Rule 100.6(d)(2) of the Rules of the Chief Administrator of the Courts, which permits a judge to “...receive the ordinary compensation for teaching a regular course of study at any college or university if the teaching does not conflict with the proper performance of judicial duties...”

         Therefore, since it is ethically allowable to accept a paid teaching position, it is likewise allowable for a judge to apply for and pursue one.
