Digest:         A judge, even when formerly a candidate for office, may not personally sell tickets to a political victory celebration.

Rule:            22 NYCRR §§100.2; 100.7(e).

Opinion:

A judge has been asked to personally sell tickets to a political victory celebration. The party is scheduled to be held within nine months of the election in which the judge is an announced candidate for judicial office.

A judge should never personally sell tickets to a political function as it creates an impermissible appearance of impropriety, regardless of when the sale takes place, and whether or not the judge is a candidate.
