Opinion 92-109

Dear Justice :

         The Advisory Committee on Judicial Ethics, at its meeting of September 24, 1992, considered your inquiry (92-109) about disqualification where your law clerk’s spouse is an assistant district attorney.

         Enclosed for your information are Opinions 88-140 and 90-196, which deal with the issue of law clerks’ spouses who are serving with the offices of legal services and the public defender, which appear before the judge. The same considerations apply where the law clerk’s spouse is associated with the district attorney’s office.
