Digest: A Surrogate Court judge may write a letter of recommendation for a court employee to a City Court judge.
Rules: 22 NYCRR 100.2.
Opinion:
A Surrogate Court Judge asks whether it is permissible to write a letter of recommendation to a City Court judge on behalf of a court employee who is applying for a position as a clerk in the other judge’s court.
Since this job reference is to another judge concerning a court employee, the judge properly may write the letter of recommendation, using judicial letterhead if the judge so desires, but, in that case, indicating that the reference is “Personal and Unofficial.”
