Digest:         A part-time judge may serve as a representative to the Mental Retardation and Developmental Disabilities Advisory Counsel.

Opinion:

         A part-time judge inquires whether he may be considered for appointment by the governor as a representative to the Mental Retardation and Developmental. Disabilities Advisory Counsel, as defined in section 13.05 of the Mental Hygiene Law.

         Section1OO.5(b) of the Rules of the Chief Administrator permits judges to participate in civic activities, and provides that, “a judge may serve as an officer, director, trustee, or nonlegal advisor of an educational, religious, charitable, fraternal or civic organization not conducted for the economic or political advantage of its members...” .

         Serving as a representative to the Counsel, as defined by the Mental Hygiene Law, is permissible under the Rules. Accordingly, the judge may have his name submitted for consideration of appointment.
