Facts/Issue:  A full-time judge asks if they may serve on the board of managers for their residential condominium association.

 

Discussion:   We have advised that a full-time judge who owns real property may serve on the board of their residential condominium, co-operative apartment building, or homeowners association, although the judge must not serve as a legal advisor, engage in decisions likely to lead to litigation, or otherwise allow the position to impair the judge’s judicial duties. 

 

Conclusion:  A full-time judge may serve on the board of managers for the judge’s condominium association, subject to generally applicable limitations on judicial speech and conduct.
