Dear Judge

         This responds to your inquiry (08-57) about the propriety of accepting a position in the town highway department in the same town where you serve as Town Justice.

         In Opinion 00-62, the Advisory Committee concluded that a part-time judge may be employed as a laborer by the town highway department, provided the judge does not preside over any cases involving the town highway department. I have enclosed a copy of Opinion 00-62 for your convenience.
