Opinion 07-54

May 17, 2007

This responds to your inquiry (07-54) about the propriety of the partners or associates of other part-time attorney-judges who sit in other courts, appearing before your court.

Section 100.6(B)(3) of the Rules Governing Judicial Conduct states that a part-time judge who is permitted to practice law:

                                       (3) shall not permit his or her partners or

associates to practice law in the court in

which he or she is a judge, and shall not

permit the practice of law in his or her

court by the law partners or associates of

another judge of the same court who is

permitted to practice law, but may permit

the practice of law in his or her court by

the partners or associates of a judge of a

court in another town, village or city who

                                       is permitted to practice law.

Accordingly, as the quoted rule makes clear, you may allow the law partners or associates of another part-time judge who is permitted to practice law - and who presides in a town, city, or village court other than your own - to appear in your court.
