This responds to your inquiry (07-169) about your obligations regarding a political sign your spouse wishes to post publicly in the yard of your joint residence. You state your spouse solely owns the property.
In Opinion 99-118, the Committee determined that a judge should advise his/her spouse of the judicial ethics concern that arises when such a sign is placed at their joint residence, and should “strongly urge” that the sign not be placed on the property. Once the judge has done so, he/she is not required to take further action.
