Opinion: 03-99

Digest: A chief clerk of a city court may seek the position of town justice of a town court in another county, provided that approval to hold such dual employment is obtained.
Rule: 22 NYCRR 50.3(a)
Opinion:
The inquirer is a Chief Clerk of a city court and asks whether he or she is permitted to run for the position of part-time town justice of a town court in another county.
The Committee is of the opinion that the two positions are not incompatible as a matter of judicial ethics. We note, however, that under section 50.3(a) of the Rules of the Chief Judge appropriate administrative approval for such dual employment must be obtained in order for the inquirer to hold both positions. 22 NYCRR 50.3(a).
