Opinion 02-02

May 13, 2002

This is in response to your inquiry (02-02) concerning the possible appearance of a news article in a local newspaper which consists primarily of a description of the jurisdiction and the working of your court, with references to you as the source of the information and explanations being provided.

The Committee finds nothing objectionable in the substance of the proposed article. Judges are permitted to explain “for public information the procedures of the court.” Care must be taken, however, to avoid “any public comment about a pending or impending proceeding in any court within the United States, or its territories.” 22 NYCRR 100.3(B)(8).
