The respondent's motion to modify the opinion and order dated October 31, 2005, by revoking the suspension and, instead, publicly censuring the respondent, was denied by decision and order on motion dated December 29, 2005. The respondent was admitted to the Bar at a term of the Appellate Division of the Supreme Court in the Second Judicial Department on May 24, 1978.
