Upon the papers filed in support of the motion and the cross motion and the papers filed in opposition thereto, it is

ORDERED that the branch of the motion which is to dismiss the appeal on the ground that the issues raised on the appeal are precluded by the doctrine of Bray v Cox (38 NY2d 350) is referred to the bench hearing the appeal for determination upon the argument or submission thereof; and it is further,

ORDERED that the branch of the motion which is to dismiss the appeal on the ground that the record on appeal is inadequate is denied on condition that on or before January 12, 2006, the appellant shall serve and file a supplemental record containing the motion papers submitted to the Supreme Court which resulted in the orders of the Supreme Court, Dutchess County, dated November 3, 2003, and May 6, 2004, respectively; and it is further,

ORDERED that the branch of the motion which is to enlarge the time to serve and file a brief is granted, the respondents' time to serve and file a brief is enlarged until February 14, 2006, and the respondents' brief must be served and filed on or before that date; and it is further,

ORDERED that the motion is otherwise denied; and it is further,
