Custody and Visitation Orders

A New York State Supreme Court or Family Court can make orders about a child's custody and visitation until the child is 18 years old.

 

Help With a Custody/Visitation Order

If you want to change the custody and/or visitation order, you can start a case to "modify" the order. Contact the court where the order was made to learn what steps you must follow. Custody and visitation orders may be changed if the court decides that the information the court relied upon when the original order was issued has changed and changing the original order is in the best interest of the child.

If the child's other parent won't follow the custody and/or visitation order, you may file an "enforcement" petition in Family Court. There will be a hearing and the court will decide if there was a violation and what to do next.
