Relief Request in a CRD Application

The Certificate of Relief from Disabilities (CRD) Application Form (question 14) asks you to list what disability you are asking for relief from:

14. Application is hereby made for a grant of a Certificate of Relief from Disabilities which will

a. relieve the holder of all forfeitures, and of all disabilities and bars to employment, excluding the right to retain or to be eligible for public office, by virtue of the fact that the certificate is issued at the time of sentence.

“b. relieve the holder of all disabilities and bars to employment, excluding the right to be eligible for public office.

c. relieve the holder of the forfeitures, disabilities or bars to employment hereinafter enumerated ___________________.

When you fill out the Application Form, check subdivision (a) only when you ask for the CRD at sentencing.

Check subdivision (b) or (c) when applying after sentencing. Subdivision (c) should be checked and completed when you are asking the court for relief from a specific disability that happened because of your conviction. Read below for common examples of what to write.


Common Examples of Relief Requested in Subdivision (c)

The following are some common examples of relief that is often filled in for question 14(c) if you are seeking to:

Obtain a driver’s license after driving without insurance
Write: “relief from the disability imposed by Vehicle and Traffic Law section 530 (5).”

Obtain a license to own or carry a firearm
Write: “relief from the disability barring me from obtaining a valid New York State license to carry a firearm.”

Getting or renewing an employment license
Write: “relief from the disability barring me from obtaining or renewing my professional license in New York State as _______________," insert the type of license you want.
