Filing and Service By Electronic Means (E-filing)


The Departments of the Appellate Division of the New York Supreme Court have approved Electronic Filing Rules (22 NYCRR Part 1245) authorizing each Department to permit or require
electronic filing in such cases and case types as it deems appropriate. 


E-filing in the First Department


Effective March 1, 2018, electronic filing in the First Department will be required in appeals in commercial matters originating in the Supreme Court, Bronx and New York Counties through the
New York State Courts Electronic Filing System (NYSCEF).


E-filing is required in the following appeals in commercial matters:

  • Matters in which notices of appeal are filed on or after March 1, 2018.

  • Matters in which notices of appeals were filed prior to March 1, 2018 and the appeal will be perfected on or after May 15, 2018. In these matters, compliance with the requirements of 22 NYCRR 1243(a)[Entry of Initial Information for Electronic Filing] will be measured from March 15, 2018.

  • Appeals on commercial matters which have already been perfected are exempt from the e-filing requirements.

Online Training

  • Online training for persons (attorneys and unrepresented litigants) who are interested in electronic filing at the Appellate Division will be available on February 14, 21 and 28, 2018 and March 7, 2018. Additional sessions will be scheduled as needed.

Formatting Specifications

In addition to the general formatting requirements set forth in Attachment A to the Electronic Filing Rules
of the Appellate Division, all documents electronically filed in the First Department shall comply with the
formatting specification set forth in the Court’s technical guideline for e-filed documents.

Motion Formatting.  Motion papers shall be filed together in one PDF, which shall contain bookmarks linking to each separate supporting document/exhibit ((See Attachment A, section 2).  For the required specifications, please see the Court’s technical guideline for e-filed documents (linked above).
